4. PRODUCTS, PRICING, AND THE FTC 30-DAY RULE
4.1. ACCURACY
We aim for perfect descriptions, but we often rely on information provided to us by the manufacturer, and cannot guarantee every manufacturer detail or color is exact.
4.2. PRICING AND TAXES
Prices may not include sales tax; all applicable taxes and shipping costs will be clearly displayed at checkout.
4.3. SHIPPING WINDOW
We typically process all orders within 20 minutes of being placed. We aim to ship all orders on the day they are placed or the morning after but this may vary depending on real world conditions. Per FTC guidelines, if we cannot ship within 30 days, we will notify you and offer a full refund.
5. RETURNS AND CALIFORNIA LAW NOTICE
Due to the nature of our products, we maintain specific policies designed to protect the health and safety of all customers and employees.
5.1. HYGIENE POLICY - ALL SALES FINAL ON OPENED ITEMS
For health and hygiene reasons, all sales are final and no returns are accepted. In exceptional circumstances a refund may be tendered but this is at the discretion of MENS.TOYS LLC.
5.2. CANCELLATIONS
Once an order has been processed, we are unable to make additions, changes, quantity adjustments, or stop it from shipping.
5.3. DEFECTIVE PRODUCTS
All products listed are sold with no warranty provided by MENS.TOYS LLC unless explicity stated otherwise on the product's listing page. However, please contact customer service with information about the defective product and what the issue is. Refunds may be issued at the discretion of customer service. All products are briefy checked for functionality to the extent possible without breaching packaging prior to shipment.
5.4. STORE CREDIT
Store credit issued by MENS.TOYS LLC expires after one (1) year of no purchase activity. Store credit has no cash value and cannot be transferred.
6. WEBSITE USE AND INTELLECTUAL PROPERTY

All content, images, and logos are owned or licensed by MENS.TOYS LLC and protected by intellectual property laws.
6.2. REVIEWS
Nothing in these terms restricts your right to publish honest, good-faith reviews or statements about our products or services.
7. DISCLAIMER AND LIMITATION OF LIABILITY

9. GOVERNING LAW, DISPUTES, AND ARBITRATION
9.1. GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. To the extent that any mandatory consumer protection laws of your state of residence apply and cannot be contractually waived, those laws are preserved solely to that extent.
9.2. INFORMAL RESOLUTION
Before initiating any formal dispute, you agree to Contact us and give us 30 days to resolve the issue informally. Most concerns can be resolved quickly this way.
9.3. BINDING ARBITRATION
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, your use of our website, or any purchase — including questions about the validity, enforceability, or scope of this arbitration clause — shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in King County, Washington, or, at your election, via videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
9.4. CLASS ACTION WAIVER
YOU AND MENS.TOYS LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If this waiver is found unenforceable with respect to any claim, that claim shall be severed and proceed in court, while all remaining claims proceed in arbitration.
9.5. JURY TRIAL WAIVER
To the extent any claim proceeds in court, YOU AND MENS.TOYS LLC EACH WAIVE THE RIGHT TO A JURY TRIAL.
9.6. EXCEPTION - SMALL CLAIMS
Either party may bring an individual claim in small claims court in King County, Washington, provided the claim qualifies and remains in small claims court.
9.7. SEVERABILITY
If any part of these terms is found unenforceable, it will be modified or removed only to the extent necessary, and the remainder will remain in full force and effect.
9.8. ENTIRE AGREEMENT
These Terms and our Privacy Policy constitute the entire agreement between you and MENS.TOYS LLC and supersede any prior agreements.
